1. What the beta phase is
Pishik is offered on a pre-release ("beta") basis: the Service is under active development. Features may be incomplete, may change substantially, may not operate as described, may contain errors or defects, and may be added, modified, suspended, or removed at any time, without notice. "Beta" describes the maturity of the software — it does not by itself determine who may sign up, and it does not change your payment obligations (see Section 5).
2. Acknowledgment of risks
You acknowledge and accept that using a beta-phase product carries inherent risks, including without limitation: (a) interruptions, downtime, and outages, scheduled or not; (b) bugs, errors, and unexpected behavior, including workflows that stall, emails that are not delivered, or statuses that display incorrectly; (c) loss, corruption, or unavailability of data entered into the Service; and (d) changes that remove or alter features you rely on. You are responsible for maintaining your own backups (the Service includes an export feature) and for not relying on the Service as your sole system of record for any critical matter while the beta phase is active.
3. No warranty; no service levels
WITHOUT LIMITING THE DISCLAIMERS IN THE TERMS OF SERVICE, THE SERVICE IS PROVIDED DURING THE BETA PHASE "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE PROVIDE NO SERVICE-LEVEL COMMITMENTS, NO UPTIME GUARANTEE, AND NO SUPPORT OBLIGATIONS DURING THE BETA PHASE. ALL LIMITATIONS OF LIABILITY IN THE TERMS OF SERVICE APPLY FULLY.
In practice, we answer questions and help customers on a best-effort basis through our Support Center — this section means only that we are not contractually obligated to provide support or to meet any service level or response time while the beta phase is active.
4. Feedback is Pishik's property
A core purpose of the beta phase is gathering feedback. "Feedback" means any suggestions, ideas, feature requests, bug reports, comments, improvements, test results, survey responses, or other input you (or your Users) provide about the Service, in any form. You agree that all Feedback is and becomes the sole and exclusive property of Pishik. To the maximum extent permitted by law, you hereby irrevocably assign to Pishik all right, title, and interest in and to all Feedback, and to the extent such assignment is not effective, you grant Pishik a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable and transferable license to use, reproduce, modify, distribute, display, and otherwise exploit the Feedback for any purpose, without attribution, compensation, or obligation to you. You represent that your Feedback does not include information you are obligated to keep confidential.
5. Fees & billing
Paid plans are billed at the prices published on the pricing page and as described in the Terms of Service. Beta status does not reduce, defer, or waive fees, and imperfections consistent with Sections 1–3 do not entitle you to credits or refunds except where required by law or expressly stated in the Terms. Pricing is now live: workspaces created during Pishik's earlier invite-only beta period have at least thirty (30) days from the date pricing went live to select a paid plan. If no plan is selected in that window, nothing happens automatically — access may be suspended by Pishik after the window closes, and that is a manual decision made by a person, never an automatic one. Any suspension pauses the workspace without deleting it: data stays retained and exportable for at least sixty (60) days after a suspension, and one message to us restores access so a plan can be chosen.
6. End of the beta phase
We may declare the beta phase over — in whole or in part — at any time, with or without notice. When that happens, the beta acknowledgment is retired from sign-up, this Beta Agreement ceases to apply to new accounts, and your use of the Service continues to be governed by the Terms of Service. Sections 3 and 4 of this Beta Agreement survive with respect to the period in which it applied.
7. Order of precedence
This Beta Agreement supplements the Terms of Service. If this Beta Agreement conflicts with the Terms with respect to the beta phase, this Beta Agreement controls; otherwise the Terms control. Capitalized terms not defined here have the meanings given in the Terms.
